Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all orders of food and beverages for pickup placed via the FCO Kuzina website.

The website is operated, and the service provided, by Makrina Schneider (FCO Kuzina), Lauenbach 60, 77883 Ottenhöfen, Germany (hereinafter "we" or "FCO Kuzina").

2. Formation of the contract

The presentation of dishes and drinks on the website does not constitute a legally binding offer, but an invitation to place an order.

By submitting an order via the website, you make a binding offer to conclude a purchase contract. The contract is formed once we accept the order, at the latest with the order confirmation or when the order is made available for pickup.

We reserve the right to reject orders, in particular in the event of unavailability of ingredients, display errors, or justified suspicion of misuse.

3. Prices and payment

All prices are final prices in euros and include statutory VAT.

Depending on your selection, payment is available by card via the payment service provider SumUp, or in cash on pickup.

For card payments, processing is handled by SumUp; their terms apply in addition. Card data is entered exclusively with SumUp and is not stored by us.

4. Pickup and handover

The order is made available for pickup at the FCO Kuzina premises, Hasenwald 22, 77883 Ottenhöfen im Schwarzwald, Germany. No shipping or delivery service is owed.

Please have your order number ready when picking up.

5. Opening hours

Orders are processed only during our opening hours (in particular on match days and during events). Orders placed outside opening hours can be processed at the next opening. Current opening hours are shown on the website.

6. Allergens and additives

We provide information about allergens and additives contained in our dishes in accordance with the Food Information Regulation (LMIV) on the menu or on request on site. Please contact us about intolerances before ordering.

7. Right of withdrawal

There is no right of withdrawal, as this concerns the delivery of food and beverages as part of leisure events and/or goods that are freshly prepared to your order and are perishable (see § 312g(2) no. 9 and no. 2 of the German Civil Code, BGB).

8. Warranty

The statutory warranty rights apply. Please check your order upon pickup and contact our staff immediately if you have any complaints.

9. Liability

We are liable without limitation for intent and gross negligence as well as for injury to life, body or health. For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise liability is excluded.

10. Final provisions

German law applies. Insofar as legally permissible, the place of jurisdiction is the provider’s registered office.

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
